<p>On  December  24,  2009,  in  a  straight  party-line  vote,  the  Senate  passed  meliorated  House  of  Representatives  bill  HR  3590  entitled  &#8220;The  Patient  Protection  and  Affordable  Care  Act&#8221;  but  commonly  known  as  the  Obama  Administration  health  care  reform  bill.  While  the  Senate  must  still  iron  out  any  divergences  with  the  introductory  House  of  Representatives  bill  in  committee,  there  is  a  substantial  likelihood  that  a heap of  form  of  reform  will  be  passed.  This  accomplishment  has  been  heralded  by  buyer  advocates  throughout  the  country.</p>
<p>However,  it  would  be  wise  for  the  pundits  and  supporters  to  exercise  caution  must  the  bill  pass.  Many  worries  have  been  voiced  among  opponents  including  that  the  bill  may  in truth  raise  costs,  diminish  medical  advancements  and  research,  and  develop  a  stratified  health  care  system  amongst  those  receiving  the  government  paid  care  and  those  who  may  afford  to  recompense  cash  for  desired  medical  treatment.  Yet,  one  of  the  most  probable  results  and  aftermaths  of  the  reform  bill  has  not  been  discussed:  the  inevitable  implementation  of  nationwide  medical  malpractice  tort  reform.</p>
<p>Tort  reform  has  been  raised  by  opponents  as  a  necessary  element  of  reform.  Their  argument,  which  has  existed  for  decades  to  aid  harm  caps  and  limits  of  liability  for  doctors,  is  that  medical  treatment  is  highpriced  in  huge  portion  to  lawsuits  brought  by  people who are in need of medical care  versus  their  doctors  and  health  care  suppliers  because  of  alleged  medical  negligence.  These  lawsuits  have  forced  medical  malpractice  insurance  companies  to  raise  insurance  premiums  for  doctors  all over  the  board,  exceptionally  in  hazardous  fields  such  as  obstetrics  and  cardiology.  In  turn,  the  high  health  insurance  premiums  are  passed  along  to  the  patient  in  the  form  of  higher  prices  and  health  insurance  costs.  Their  position,  in  sum,  is  that  any  discussion  of  health  care  reform  designed  to  reduce  medical  costs  ought to  include  implementation  of  limits  on  civil  harm  and  liability  for  doctors.</p>
<p>Prior  to  the  health  care  reform  bill  there  was  a good deal of  validity  to  this  theory.  If  one  assumes  that  health  care  is  a  priceless  public  resource  or  right  and  the  government  has  an  interest  in  managing  the  cost  and  availability  of  health  care  for  the  public,  then  medical  malpractice  tort  reform  may  very  well  be  permitted  a  special  exception  in  ordinary  tort  law  that  would  bar  or  limit  monetary  compensation  for  injured  people who are in need of medical care  in  some  cases.</p>
<p>Without  further  addressing  the  validity  of  this  argument&#8211;much  of  which  is  demonstrably  untrue  through  readily  available  facts  such  as  medical  malpractice  insurance  company  profits  derived  solely  by  the  high  premiums  charged  to  doctors  equated  to  claims  remunerated  to  injured  patients&#8211;the  argument  for  medical  malpractice  tort  reform  will  only  be  strengthened  with  the  passage  of  the  reform  bill.  In  fact,  national  medical  malpractice  tort  reform  is  all  but  guaranteed  as  the  government&#8217;s  interest  in  managing  health  care  costs  moves  from  theoretical  to  real.</p>
<p>We  know  very  little  in regards to  the  health  care  reform  bill.  One  thing  we  do  know,  though,  is  that  the  bill  will  fabricate  a  board  called  the  &#8220;Independent  Medical  Advisory  Board&#8221;&#8211;a  government  bureaucracy  tasked  with  cutting  health  care  costs.  This  panel  has  been  famously  been  called  a  &#8220;death  panel&#8221;  by  former  Vice-Presidential  Nominee  Sarah  Palin  because  it  would  arguably  ration  health  care  procedures  as  a  way  to  eliminate  or  reduce  the  frequency  of  procedures  which  provide  less  gain  than  the  costs  that  are  incurred  (e.g.,  unnecessary  diagnostic  testing,  barring  payment  of  mammograms  for  women  beneath  50,  etc.).  Regardless  of  what  the  panel  is  euphemistically  called,  rationing  will  be  an  inevitable  result  to  save  the  government  and  taxpayer  costs  on  the  front  end  side  of  the  health  care  transaction.</p>
<p>Equally  likely,  the  Board  will  finally  adopt  medical  malpractice  tort  reform  as  a  way  to  limit  costs  on  the  back  end  side  of  the  health  care  transaction.  Like  MediCare  and  Medicaid,  doctors  and  health  care  suppliers  will  be  asked  to  receive  artificially  low  payments  for  their  service  thereby  reducing  their  net profit  margin  and  their  willingness  to  participate  in  the  new  federal  health  care  system.  One  incentive  the  government  may  provide  to  these  doctors&#8211;perhaps  the  only  incentive&#8211;is  to  help  in  reducing  malpractice  insurance  costs  by  limiting  medical  malpractice  lawsuits  and  damages.</p>
<p>Medical  malpractice  reform  has  already  been  raised  by  the  American  Medical  Association  as  a  way  President  Obama  may  earn  their  members  aid  for the duration of  the  passage  of  this  debatable  bill.  Understandably,  Obama  has  been  reluctant  to  agree  to  such  a  concession  as  both  he  and  the  Democratic  Party  rely  to a considerable degree  on  the  donations  of  trial  lawyers  for  their  political  future.  Yet,  what  happens  when  the  Republicans  win  the  White  House,  political  favor  turns,  or  the  cost  of  the  federal  health  care  program  skyrockets?  Undoubtedly,  pressure  would  mount  for  tort  reform  to  be  implemented,  perchance  to  such  a  level  that  politicians  and  bureaucrats  would  be  forced  to  concede.</p>
<p>This  is  a  sad,  inevitable,  and  ignored  consequence  of  the  proposed  health  care  reform  bill.  Under  most  states&#8217;  medical  malpractice  statutes,  a  doctor  cannot  be  found  liable  for  injuring  a  patient  unless  their  care  fell  &#8220;below  the  ordinary  of  care  within  the  community&#8221;.  That  means  a  doctor  will have to  not  be  plainly  negligent,  but  almost  grossly  negligent,  before  he  may  be  found  responsible  for  his  patient&#8217;s  injuries  caused  by  his  treatment.  Clearly,  doctors  who  meet  this  usual  ought to  be  held  responsible  for  their  conduct  and  their  persons who requires medical care  must  be  compensated.  To  remainder  share  of  the  nation&#8217;s  health  care  costs  on  the  backs  of  these  injured  persons who requires medical care  is  merely  wrong.</p>

<p>During  a  recent  televised  debate  on  healthcare  reform  amid  pundits  on  a  standard  24-hour  news  channel,  the  topic  of  health  care  rationing  came  up.  The  anti-government-option  pundit  pointed  out  the  requirement  of  rationing  beneath  the  proposed  legislation.  The  pro-government-option  pundit  retorted,  &#8220;There  already  is  rationing  in  the  system.  It&#8217;s  just  rationed  according  who  may  afford  to  pay.&#8221;</p>
<p>The  significance  of  this  interchange  was  the  recognition  that  there  already  is  a  healthcare  shortage  in  this  country.  As  cited  economist  Thomas  Sowell  once  pointed  out;  &#8220;The  introductory  rule  of  economics  is  that  there  is  never  sufficient  supply  to  meet  demand.  The  introductory  rule  of  politics  is  to  ignore  the  initial  law  of  economics.&#8221;</p>
<p>Without  talking about  the  merits  of  any  form  of  healthcare  rationing,  rationing  is  percentage  of  our  medical  scheme  and  will  be  a  more outstanding  share  of  our  scheme  disregarding  of  how  health  care  reform  manifests.</p>
<p><b>1.  Free  Market  Rationing</b></p>
<p>Under  the  free  market  approach,  healthcare  is  rationed,  as  the  above  pundit  noted,  according  to  who  may  pay.  We  also  have  programs  of  Medicare  and  Medicaid,  as  well  as  the  Children&#8217;s  Health  Insurance  Program  (CHIP)  that  disrupts  the  free  market;  however,  as  a  generous  nation,  we  are  prepared  to  aid  the  poor.  Volumes  have  been  written  talking about  both  the  merits  and  evils  of  the  free  market  scheme  and  we&#8217;re  not  prepared  to  tackle  that  issue  here  &#8211;  yet.</p>
<p><b>2.  Government  Rationing</b></p>
<p>When  the  Obama  administration  speaks  of  reducing  &#8220;inefficiencies&#8221;  or  &#8220;cutting  costs&#8221;  they  speak  of  doing  that  through  a good deal of  sort  of  review  board.  That  review  board  would,  ostensibly  determine  which  treatments  are  economical  and  which  aren&#8217;t  thereby  limiting  available  health  care  options.  There&#8217;s  also  discussion  of  the  QALY  program  or  Quality-Adjusted  Life  Years  where  the  cost  of  one&#8217;s  treatments  is  weighted  versus  the  amount  of  years  the  person  may  be  somewhat  expected  to  live.  QALYs  are  used  in  Great  Britain  as  a  means  of  rationing  healthcare.  The  Obama  administration  grasps  that  there  ought to  be  a great deal of  form  of  rationing  to  manage  costs.  As  Thomas  Sowell  would  point  out,  when  you  take  the  price  factor  out  of  any  dealing  you  manufacture  shortages. <blockquote><i>&#8220;Trust  me  when  I  tell  you  that  I  lived  through  this  already.    Back  for the duration of  the  Carter  years,  the  only  health  care  option  we  had  was  military  medicine.</p>
<p>If  you  necessitated  to  see  a  specialist,  you  had  to  call  the  main  appointment  desk  starting  at  8:00AM  on  the  firstborn  day  of  the  month.    The  phone  number  would  evidently  be  without disruption  busy,  so  you&#8217;d  sit  there  redialing  for  hours.</p>
<p>Once  you  in the long run  got  through,  90%  of  the  time  the  appointments  for  that  month  would  already  be  filled.    So,  you&#8217;d  have  to  wait  until  the  primary  day  of  the  next  month  and  undertake  again. <p><b>Are  You  Prepared?</b></p>
<p>One  of  the  real  crises  of  the  current  healthcare  scheme  is  a  lack  of  adequate  health  care  providers.  As  government  looks  for  ways  of  letting down  cost  without  ways  of  encouraging  more  suppliers  to  enter  the  market,  further  shortages  are  inevitable.  Rationing  by  cost,  inconvenience,  or  government  board  all  means  that  healthcare  services  will  be  more  difficult  for  the  public  to  obtain.</p>

If  one  assumes  that  health  care  is  a  priceless  public  resource  or  right  and  the  government  has  an  interest  in  managing  the  cost  and  availability  of  health  care  for  the  public,  then  medical  malpractice  tort  reform  may  very  well  be  permitted  a  special  exception  in  usual  tort  law  that  would  bar  or  limit  monetary  compensation  for  injured  persons who requires medical care  in  some  cases.</p>
<p>Without  further  addressing  the  validity  of  this  argument&#8211;much  of  which  is  demonstrably  untrue  through  readily  available  facts  such  as  medical  malpractice  insurance  company  profits  derived  solely  by  the  high  premiums  charged  to  doctors  equated  to  claims  salaried  to  injured  patients&#8211;the  argument  for  medical  malpractice  tort  reform  will  only  be  strengthened  with  the  passage  of  the  reform  bill.  In  fact,  national  medical  malpractice  tort  reform  is  all  but  guaranteed  as  the  government&#8217;s  interest  in  managing  health  care  costs  moves  from  theoretical  to  real.</p>
<p>We  know  very  little  regarding  the  health  care  reform  bill.  One  thing  we  do  know,  though,  is  that  the  bill  will  give rise to  a  board  called  the  &#8220;Independent  Medical  Advisory  Board&#8221;&#8211;a  government  bureaucracy  tasked  with  cutting  health  care  costs.  This  panel  has  been  famously  been  called  a  &#8220;death  panel&#8221;  by  former  Vice-Presidential  Nominee  Sarah  Palin  because  it  would  arguably  ration  health  care  procedures  as  a  way  to  eliminate  or  reduce  the  frequency  of  procedures  which  provide  less  gain  than  the  costs  that  are  incurred  (e.g.,  unnecessary  diagnostic  testing,  barring  payment  of  mammograms  for  women  underneath  50,  etc.).  Regardless  of  what  the  panel  is  euphemistically  called,  rationing  will  be  an  inevitable  result  to  save  the  government  and  taxpayer  costs  on  the  front  end  side  of  the  health  care  transaction.</p>
<p>Equally  likely,  the  Board  will  at last  adopt  medical  malpractice  tort  reform  as  a  way  to  limit  costs  on  the  back  end  side  of  the  health  care  transaction.  Like  MediCare  and  Medicaid,  doctors  and  health  care  suppliers  will  be  asked  to  receive  artificially  low  payments  for  their  service  thereby  reducing  their  net income  margin  and  their  willingness  to  participate  in  the  new  federal  health  care  system.  One  incentive  the  government  may  provide  to  these  doctors&#8211;perhaps  the  only  incentive&#8211;is  to  support  in  reducing  malpractice  insurance  costs  by  limiting  medical  malpractice  lawsuits  and  damages.</p>
<p>Medical  malpractice  reform  has  already  been  raised  by  the  American  Medical  Association  as  a  way  President  Obama  may  earn  their  members  help  for the duration of  the  passage  of  this  debatable  bill.  Understandably,  Obama  has  been  reluctant  to  agree  to  such  a  concession  as  both  he  and  the  Democratic  Party  rely  to a great extent  on  the  donations  of  trial  lawyers  for  their  political  future.  Yet,  what  happens  when  the  Republicans  win  the  White  House,  political  favor  turns,  or  the  cost  of  the  federal  health  care  program  skyrockets?  Undoubtedly,  pressure  would  mount  for  tort  reform  to  be  implemented,  perhaps  to  such  a  level  that  politicians  and  bureaucrats  would  be  forced  to  concede.</p>
<p>This  is  a  sad,  inevitable,  and  ignored  consequence  of  the  proposed  health  care  reform  bill.  Under  most  states&#8217;  medical  malpractice  statutes,  a  doctor  can not  be  found  liable  for  injuring  a  patient  unless  their  care  fell  &#8220;below  the  frequent  of  care  within  the  community&#8221;.  That  means  a  doctor  will have to  not  be  merely  negligent,  but  almost  grossly  negligent,  before  he  may  be  found  responsible  for  his  patient&#8217;s  injuries  caused  by  his  treatment.  Clearly,  doctors  who  meet  this  frequent  must  be  kept  responsible  for  their  conduct  and  their  persons who requires medical care  will have to  be  compensated.  To  remainder  percentage  of  the  nation&#8217;s  health  care  costs  on  the  backs  of  these  injured  persons who requires medical care  is  plainly  wrong.</p>

<p>A Virginia federal judge on Monday found a key part of President Barack Obama&#8217;s sweeping health care reform law unconstitutional, setting the stage for a protracted legal struggle likely to wind up in the Supreme Court.</p>
<p>U.S. District Judge Henry Hudson struck down the &#8220;individual mandate&#8221; requiring most Americans to purchase health insurance by 2014. The Justice Department is expected to challenge the judge&#8217;s findings in a federal appeals court.</p>
<p>Hudson&#8217;s opinion contradicts other court rulings finding the mandate constitutionally permissible.</p>
<p>&#8220;An individual&#8217;s personal decision to purchase &#8212; or decline purchase &#8212; (of) health insurance from a private provider is beyond the historical reach of the U.S. Constitution,&#8221; Hudson wrote, also stating that &#8220;no specifically articulated constitutional authority exists to mandate the purchase of health insurance.&#8221;</p>
<p>&#8220;Despite the laudable intentions of Congress in enacting a comprehensive and transformative health care regime, the legislative process must still operate within constitutional bounds,&#8221; Hudson added. &#8220;Salutatory goals and creative drafting have never been sufficient to offset an absence of enumerated powers.&#8221;</p>
<p>A federal judge in Virginia ruled in favor of the administration earlier this month over the purchase requirement issue, mirroring conclusions reached by a judge in Michigan back in October.</p>
<p>Virginia officials had argued that the Constitution&#8217;s Commerce Clause does not give the government the authority to force Americans to purchase a commercial product &#8212; like health insurance &#8212; that they may not want or need. They equated such a requirement to a burdensome regulation of &#8220;inactivity.&#8221;</p>
<p>Virginia is one of the few states in the country with a specific law saying residents cannot be forced to buy insurance.</p>
<p>&#8220;I am gratified we prevailed,&#8221; said Virginia Attorney General Ken Cuccinelli, a conservative Republican elected in 2009. &#8220;This won&#8217;t be the final round, as this will ultimately be decided by the Supreme Court, but today is a critical milestone in the protection of the Constitution.&#8221;</p>
<p>Incoming House Majority Leader Eric Cantor, R-Virginia, urged Obama and Attorney General Eric Holder to request an expedited appeal to the Supreme Court.</p>
